    Same deer shot by two hunters

    It is an interesting question though. My take would be first lethal shot and with a chance of finding the animal is the hunter who tags. An example is an elk walking by and you double lung it, get up to it and find somebody single lunged it from the other side and there is a decent blood trail you didn't know existed. Now the first shot was a lethal shot and there was a good chance it could be recovered. If the other hunters come up blood trailing I have no problem telling them it is theirs if they want it as they had the first lethal shot. Now if the shot was in the shoulder and not lethal then they have no claim to it as mine was the first lethal shot. Pretty easy to figure out. That is why I don't rifle hunt anymore. Don't want to be 200 yards away from an animal and have somebody shoot from 1000 yards at an animal I am stalking in on.

    Before you buy used, nothing against it, go to the dealer. A few years ago I found a new 2 year old still sitting on the lot. The clearance price was the same as most used ATV's and I could use their financing so I only had to pay $70/month. The problem was I had to get clearance from the wife and she said I needed one to carry my daughters so I got my CJ-5 back from my sister.

    You have to have a reputation that could be damaged and actual damages to occur to sue somebody over slander. I never heard what the charges were, only speculation. I asked my wife, the attorney, why a search warrant would be sealed. She said to protect an informant and later in the case it would be unsealed due to the fact the accused has a right to cross examination. So no law was broken only a court order where the judge could have you fined or incarcerated for contempt of court.

    My card got hit about 5 times today. It all started when I had to fill up with gas this morning, then lunch, then Cabela's, then beer for the house tonight, then dinner. I think that is all it is going to get hit but I have been wrong before.

    NM Unit 23 and 24

    Since they say the unit I bet the Burros are included. I also saw where they want to split the Sept. and Jan. hunts. Right now I can hunt all of Sept. and go back in Jan. and if I don't get a buck I can go get a doe in the Silver City Management area. Sounds like the Burro hunt you can't go to Silver City but they are going to add that you can.
  8. Bad news. The NMG&F Commission is opening the deer rule for public input. It looks like they are decreasing deer tags for unit 23 and 24. This may be why for the past two years they have not had tags in those units go into the leftover tags after the draw. Going to be harder to draw deer tags in those units.

    Seriously? I would never in a million years miss a day of hunting for those dang things. Ive been ignoring them for years. I would love to do my civic duty but every time I get called I have to answer honestly. When you grew up at the state police crime lab because your father was a firearms examiner, now he does his own accident reconstruction in civil cases, your wife is an attorney who will have several cases on the docket, was a deputy district attorney for 10 years, you yourself worked for a police department for four years and did self prosecutes in Municipal court, volunteer with G&F as a hunter education instructor, You tend to know several attorneys, expert witnesses, police officers and the judges themselves, they tend to excuse you right away.

    Only one shotgun? My dove/quail shotgun is an Ithaca model 51 Featherlight, my turkey gun is a Remington 870, I have a single shot for squirrels, and an over under for Pheasants. You can't ever have too many guns.

    Sir Royal--When I replace my stolen welder I will make you some dummy trail cam security lock boxes. I take cams that don't work and put in them so it is no loss. About the only thing that works is a red light flashes when the PIR is activated. I weld the boxes where it takes quite a bit of effort to get into them. Then when they get into them there is a note that says "Was it worth it?". After having about 3 of these messed with I can leave similar ones out year round. Makes them stop and think if there are working game cams in there or not and if they want to go through the effort for nothing again.

    As a side note I got a jury duty summons today. July 30 to Sept. 28th so it is going to interfere with hunting this year. I bet they don't let me sit on the jury however so hunting is back on.

    With all this confessing I do have to say Glitter was the name of a pretty hot stripper here and I watched her multiple times. The other thing I have to confess that I did when in college and under 21 bought and declared a bottle of Amaretto, Kalua, and Jose Cuervo from Palomas, Mexico, paid duty tax on two bottles. The 10 other bottles of tequila I had hidden they didn't find when I drove back across. There I feel much better now.

    Nothing at all. It also doesn't matter if you get there first and use it. That is why my blind is always with me, 4'X 12' camo burlap is easy to set up and take down. Mix it in with some natural features and nobody knows where I set up unless they happen upon me.

    again, How is someone to know if you are east/west/100yds/3miles off the road??? a sign,parked vehicle doesnt give you the entire area... I have a sign that says" Hunter at water at end of road." I don't say not to come down, just hope that others will come in quietly. These are also dead end roads, as already been stated, and the only way to get to the water is to walk within 10 feet of me, 40 yards from the water. I am not "claiming" the spot but letting others know they may want to avoid a 1 1/2 mile round trip walk if they don't want to deal with other hunters since these roads are no longer passible to motorized vehicles. USFS closed gates and signs. Just trying to be courteous to other hunters. I was also pointing out that just because a vehicle is not there, somebody might already be there.

    The only time I put up a sign is on dead end roads to let others know I am in the area. Basically it just says I am hunting the end of the road. I usually am walking or on my bike so you won't see a vehicle to let you know I am down there. Same goes for others who might be dropped off, so just remember somebody may be at the end of the road without a vehicle around.

    Here is what I am reading and from my personal knowledge of the law. Now this is on NM law and not AZ law, I am not an attorney but my wife is for 20 years, (she has given me no advice on this case.) so I have a good layman knowledge of how the courts work. The case was filed on 6/1/18 and the motion to dismiss was 6/5/18. Here is what I am betting. A law enforcement officer can only file in Magistrate court or Municipal court here, then it is up to the District Attorney to move to District Court or keep it in Magistrate Court. Most of the Municipal cases are officer prosecute cases. The officer filed the charges and served the search warrant. Then the District Attorney reviewed the case. Since time starts running when the charges are filed the DA could dismiss the charges and refile them later or take it to the Grand Jury. We still have those here in NM. The other option the DA has is to file a Nolle Pros which means they choose not to pursue the case at that time but could in the future with new evidence. Since there was only 4 days between the filing and the dismissal, the defense attorney would not have had the discovery by then, I bet the DA dismissed without prejudice and can refile the case. Usually our cases are dismissed without prejudice so until I can see the motion and order I can't say if it was dismissed with or without prejudice. They might have done that to allow another jurisdiction the ability to prosecute and not run into time issues with speedy trial. They also could have done that to allow more time to put the case together and not have a time issue with discovery. So everybody that thinks it was outright dismissed and won't be refiled or those that have convicted him, wait to see what happens in the courts. My wife, who was a prosecutor for 10 years and a defense attorney for 10 year has outright dismissed cases from cops being lazy and not turning over discovery, basically bad cop no crime fighting biscuit. She has also gotten cases dismissed or had juries return not guilty verdicts. I tend to believe that something illegal was done. Whether it will proven or not is yet to be seen.

    They only dismissed count 1 Contributing/ Delinquency of a minor. All the game charges haven't been dismissed. Wait and see what happens.

    And in Eastman's... It will all come out in court more than likely a plea agreement. My guess is others new about this buck and had trail camera pics. He had a tag for another unit than where this buck lived. The first charge is contributing to the delinquency of a minor so probably had someone under 18 with him. Then there are two counts of having illegal game. There was enough evidence to get a warrant so get more popcorn as this will take a while, might even hit page 40.

    Fixed it.Maybe it's the Miller light I'm drinking but Idk what swear word starts with rIt's not a swear word but "raped" would work. I would say "ridden" like Broke Back Mountain. So the question is who is going to Snowflake on July 2nd for the arraignment? Dont bother. The arraignment is nothing more than pleading guilty or not guilty. No arguments will be heard or evidence presented. Show up for the hearing. Thats the good stuff. The arraignment is the reading of the charges, make sure the charges are understood, and a plea entered. Usually conditions of release, COR, are set like no hunting, drinking or drugs, etc..
