Does anyone know the specifics of this case? Was he flying home on a 737 at 30k feet or did he charter a cesna and was flying around the strip at 750 feet? If it's the latter, I would say that's pretty clear cut that he was scouting with the aid of an aircraft.

Flying a unit looking for animals isn't illegal, Flying during the OTC elk hunt from April -July IS illegal. If he was flying during the OTC non permit elk hunt from April-July and that is what he was sited for,  I think its a stupid violation. Sure it is a violation but stupid. I seriously doubt he was looking for elk with a deer tag in his pocket. Maybe that is why the game and fish put those dates for the OTC elk???

 IF he was flying within the illegal time frame of his hunt I hope justice is served.

I've never flown a unit looking for animals, BUT if I was going to fly the strip I probably would have completely missed the OTC elk hunt up there. I'm not saying it is right I'm just saying that I probably would have missed it. If he was legal in every other way I think its a little bit of BS charge, but oh well. It is the law so we shall see what happens.

I don’t think you would have missed it. I think you’re pretty smart. I think you’re one of the best hunters around and you hang with people that are knowledgeable as well, just like Koury. I wouldn’t take healthcare advice off you of course, but I think you’d have figured this out. 

I also don’t think it was the elk season that got him busted.

Remember Houston, this is YOUR profession.  Very doubtful he did not know exactly what he was doing.  If there is anyone that should have known, it was him. The owner, head guide of a larger guiding outfit.  I am far from a guide hater, as I have a few buddies who guide.  They get a lot of flak, often times undeserved. Knowingly, violating game laws tho, is a hard one to defend.

He was far away from home for a senic flight, maybe he was ski diving. Hopefully it plays out and we get the truth and the game and fish aren't no angels either.

The waters have been muddied, there’s no official word that OTC elk had anything to do with it

I always have a lion tag, that means 9-10 months out of year no beuno flying.

If people would read the law you would see lion season does not count. And it doesnt matter if you have a tag or not. It's just if there is an open season.

Yep didn't read all of it, just the big game tag part of it. No worries here, I would never fly to find animals anyways. As his profession you are 100% correct, he should of known better.
